Privacy policy
How we process personal data when you visit the AtgaukSkolą site at linden.lt/skolos, use the calculators or write to us. The Lithuanian version prevails.
1. Who processes your data
AtgaukSkolą is a court debt-recovery service provided by the law firm Advokatų profesinė bendrija „Jurkonis ir partneriai LINDEN“ (“Linden”, “we”). Linden is the controller:
- company code 304034743;
- address Pylimo g. 19-16, LT-01141 Vilnius, Lithuania;
- e-mail info@linden.lt, phone +370 5 212 1506.
We comply with the General Data Protection Regulation (EU) 2016/679 (“GDPR”) and other data protection law. For any question about how we handle data, write to info@linden.lt.
2. Website visitors
The site's pages, fonts, images and our code load from our server in Lithuania. We use no social media plugins. Nothing loads from Google until you accept statistics cookies (see section 11).
The web server logs requests: IP address, time, page opened and browser type. These records keep the site running and secure. The legal basis is our legitimate interest (GDPR Article 6(1)(f)). They are kept for no longer than 2 months.
3. Calculators
The stamp duty calculator and the business calculator do all their work in your browser. The amounts and dates you enter are not sent to us and are not stored anywhere.
4. Questions sent through the contact form
What we receive
- your name and e-mail address;
- your phone number and company name, if you give them;
- the text of your message, the page you sent it from and the time;
- if you came through a tagged link (for example from our newsletter or a partner's website): the link's source tags (utm_). We do not store them in your browser.
We use the IP address only to limit repeated submissions and to block automated programs. We do not store it with your message.
Why we use it, and on what basis
We use the data to answer your question and, if you ask, to assess the debt and prepare an offer. The legal basis is our legitimate interest in answering questions we receive and preparing offers (GDPR Article 6(1)(f)).
We use the link source tags to know where questions come from. The legal basis is our legitimate interest (GDPR Article 6(1)(f)).
We may also use your e-mail address and company name to offer our services: to send you an offer by e-mail. The legal basis is our legitimate interest in offering our services (GDPR Article 6(1)(f)). We send offers by e-mail only to e-mail addresses of legal entities (companies and organisations), not to personal ones (for example gmail.com) or those of self-employed individuals. Every such e-mail says how to opt out.
You can opt out of our offers at any time: reply to our e-mail or write to info@linden.lt. You have the right to object at any time to the processing of your data for direct marketing. Once you object, we no longer process it for that purpose (GDPR Article 21(2) and (3)).
You are not obliged to provide the data, but without a name, e-mail address and message we cannot answer. We do not send you an automatic e-mail about your message: we answer ourselves.
Where the data goes
- A copy of your message is kept on our server in Lithuania for up to 30 days, so it is not lost if one of the systems below is briefly down.
- MailerSend, an e-mail service that delivers the notice of your message to info@linden.lt.
- A copy of the message is saved in Linden's internal notes, which are kept on Linden's own computers.
Please do not send special categories of data, such as health data, or personal ID codes through the form.
5. Debtors' data in your message
When you write about a debt, you may give the debtor's name, the amount and the documents it arises from. We use this data only to assess the debt and answer you. The legal basis is our and your legitimate interest in assessing whether the debt can be recovered in court (GDPR Article 6(1)(f)).
We do not inform the debtor separately, because we keep the data under the advocate's duty of professional secrecy (GDPR Article 14(5)(d)). Give only what is needed to assess the debt: the form does not need the debtor's personal ID code.
6. Registering at bylos.linden.lt
The site's main button leads to a separate service, bylos.linden.lt, where you register and submit the debt. That service's terms of use and its own privacy notice apply there. This site does not receive your registration data.
7. Service providers
The following providers help us process data. UAB Servera and MailerSend process data on Linden's behalf and under its instructions; each of them has a data processing agreement with us. Google Ireland Limited processes Google Analytics data as an independent controller (see section 11).
| Provider | Purpose | Where data is processed |
|---|---|---|
| UAB Servera (Lithuania) | Servers for the website, the contact form and e-mail | Lithuania (EU) |
| MailerSend, Inc. (USA) | The notice of a new message to info@linden.lt | EU (Belgium); transfer to the USA possible |
| Google Ireland Limited (Ireland) | Google Analytics visit statistics, only with your consent | EU; transfer to the USA possible |
8. Data outside the EEA
The website and contact form servers are in Lithuania, and the e-mail provider's data centre is in Belgium. MailerSend is not an EU company, so under its contract it may access the data or transfer it outside the European Economic Area. Such a transfer relies on the European Commission's standard contractual clauses (MailerSend's data processing addendum).
Google Analytics data (only with your consent) may be transferred by Google Ireland Limited to Google LLC in the United States. That transfer relies on the European Commission's standard contractual clauses included in Google's terms.
9. How long we keep data
| Data | Period |
|---|---|
| A message that does not lead to a contract (including any debtor data in it) | 1 year after the last correspondence, as for e-mail enquiries to Linden |
| A message that leads to a contract | Becomes part of the client file and is kept for 10 years after the service (general limitation period, Civil Code Article 1.125(1)) |
| Backup copy of a message on our server | Up to 30 days |
| Web server logs | Up to 2 months |
| Google Analytics statistics (only with consent) | Google Analytics keeps event data for 2 months and user-level data for up to 14 months from the last visit, then deletes it automatically |
| Cookies | See section 11 |
10. Your rights
You have the right to:
- know what data we hold about you and get a copy;
- have inaccurate data corrected;
- have data erased;
- restrict its processing;
- object to processing based on our legitimate interest;
- have your data transferred to another controller;
- withdraw your consent to statistics cookies at any time (see section 11);
- lodge a complaint with the State Data Protection Inspectorate (Valstybinė duomenų apsaugos inspekcija, L. Sapiegos g. 17, LT-10312 Vilnius, vdai.lrv.lt).
These rights are subject to the conditions and exceptions set by law. Send your request to info@linden.lt. We answer without undue delay and within one month; in complex cases this may be extended as GDPR Article 12(3) allows.
12. Changes
We may update this policy when the site, the service or the law changes. The current version is always on this page, with the date of the last update at the top. This site's earlier privacy policy (23 May 2018) no longer applies.
